Terms and Conditions – IT Genixs
Welcome to IT Genixs. By engaging with our services, you agree to abide by the following terms and
conditions:
1. Project Initiation
- The project will commence only after you confirm your satisfaction with our initial consultation and
service proposal.
- We reserve the right to delay or decline the project if the client does not adhere to our company’s
onboarding process.
2. Advance Payment Policy
- As per IT Genixs policy, no project will begin without receiving an advance payment.
- The advance amount will be calculated as a percentage of the total project cost and will be communicated
beforehand.
3. Payment Structure
- The total project amount will be subject to additional GST (Goods and Services Tax) as applicable.
- All payments must be cleared as per the agreed payment milestones shared during project planning.
4. Non-Refundable Clause
- All payments made to IT Genixs are strictly non-refundable, regardless of the stage of the project or
client decision to discontinue.
5. Project Modifications & Changes
- Any modification, correction, or addition requested after project finalization will be treated as an
extra service.
- Clients will be charged additional fees for such changes, based on the complexity and effort required.
6. Project Delivery Timeline
- Project timelines will be discussed and fixed during planning. Delays from the client’s end (e.g.,
delayed content, approval, etc.) may impact the final delivery schedule.
7. Client Responsibilities
- The client must provide all required content, images, login credentials, and support documents before
the project begins.
- Any delay in submission of these essentials may result in delay of delivery or additional charges.
8. Intellectual Property
- Upon full payment, the client will own the final deliverables. However, IT Genixs reserves the right to
showcase the project in its portfolio unless otherwise agreed in writing.
9. Confidentiality
- Both parties agree to maintain confidentiality of any shared sensitive business information, source
code, and strategies.
10. Termination Policy
- In case of violation of terms, misconduct, or non-payment, IT Genixs holds the right to terminate the
project or suspend services without prior notice.
Additional Terms
- Project Abandonment: If the client does not respond or provide required inputs for more
than 15
days, the project will be considered abandoned, and IT Genixs will not
be liable for refund or continuation.
- Content Responsibility: All content (text/images/videos) provided by the client must be
legally
owned. IT Genixs is not responsible for copyright issues arising from
client-provided material.
- Security & Privacy: Client data and project information will be kept confidential.
However,
IT Genixs is not liable for security breaches caused by third-party
services (e.g., hosting providers).
- Third-Party Integrations: Any API, plugin, or third-party tool requested by the client
will be subject
to availability, pricing, and terms of that provider.
- Performance Guarantee: IT Genixs guarantees project functionality as per scope.
However, no
guarantee is provided for traffic, sales, or user engagement after
deployment.
- Browser & Device Compatibility: Projects are tested for modern browsers and standard
mobile devices.
Legacy browsers or custom devices are not included unless requested
explicitly.
- Backup & Restoration:Regular backups are the client’s responsibility unless a separate
backup
service is purchased. Restoration requests may involve extra cost.
- Training & Documentation: Basic usage instructions may be provided if included in the
project scope.
In-depth training or documentation is chargeable separately.
- Email & Communication Delay: All official communication must happen via
company-approved channels.
Delayed responses from clients may shift deadlines and delivery
schedules.
- Review & Feedback Window: After project completion, the client must review the project
within 7
working days. If no response is received, the project will be considered
auto-approved.
